To pay for an additional two months of tax relief under the Senate version or 12 months under the House version, more than $3,000 of new taxes will be imposed on every $150,000 mortgage backed by Fannie or Freddie. A family taking out a $250,000 mortgage will pay $5,000 more in taxes–directly and solely because of this bill– hidden in their future mortgage payments. This is atrocious public policy. It shifts the burden for this bill to future homebuyers, kicks the housing market when it’s already down, makes it that much more expensive for home buyers to re-enter that market, and adds to the pressures that have chronically depressed everyone’s home values. Under the new health care bill all real estate transactions will be subject to a 3.8% Sales Tax. If you sell a $400,000 home, there will be a $15,200 tax. To make matters worese, Anyone that has had a foreclosure in their past and wants to buy a home will face some challenges.&lt;br /&gt;&lt;br /&gt;1.  Must be 7 years out, unless there are extenuating circumstances, such as death in family, loss of income due to loss of job and all will have to be documented.&lt;br /&gt;&lt;br /&gt;2. Name on sales contract appears as James Smith.  He signs the sales contract as James A. Smith and puts in the loan application to us As James Allen Smith.  We pull credit as James Allen Smith.  &lt;br /&gt;&lt;br /&gt;2.     When we get the loan into process we have to order the 4506-T for tax transcripts on all loans.  If the 4506-T does not appear exactly as how Mr. Smith filed his 1040’s, we then have to retype the 4506-5, get him to sign exactly as how he filed his taxes, then we can get the transcripts.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;HOW TO SOLVE PROBLEM:&lt;/b&gt;&lt;br /&gt;&lt;br /&gt;       A.  When a sales contract is written, ask the client how their names appear on their tax returns and make the sales contract match those names.&lt;br /&gt;&lt;br /&gt;       B.  Double check that clients have signed the sales contract correctly.&lt;br /&gt;&lt;br /&gt;This alleviate the need for Lenders/Loan Processors from having to repull credit in the correct name and asking you to obtain an amendment to the contract showing the correct name.&lt;br /&gt;&lt;br /&gt;C. It’s a tougher market, home prices have fallen a lot, and many are trying to get as much money as possible to recoup their investment. We Realtors feel your pain and we’re on your side. But sometimes, sellers do things that make it harder to sell a home for what it’s worth.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Here are five things sellers do that make their real estate agents cross their fingers, and hope for the best.&lt;br /&gt;&lt;br /&gt;1. Sellers who think their property is unique and therefore worth more money.&lt;br /&gt;&lt;br /&gt;A seller’s home is special to them; they’ve put a lot of heart, soul, and money into fixing it up. It may be where they started a family or built a lifetime of memories. Most agents get that, but trust me, unless it’s the Winchester Mystery House, most properties aren’t that unusual.&lt;br /&gt;&lt;br /&gt;When a seller believes their home is unique, however, they also believe it’s worth more and can fixate on an asking price that’s too high, despite the advice of an agent. If it’s priced too high, a home will sit on the market for months. Unfortunately, nine out of 10 times, the seller will end up selling for less money than they would have gotten if the home was priced appropriately from the start.&lt;br /&gt;&lt;br /&gt;2. The seller doesn’t clean up the home.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Sellers: It’s important to pick up the home before a showing. Potential buyers touring a home probably won’t appreciate stepping on a child’s toy or fail to see the charm of a dog’s discarded tennis ball. Buyers want to feel that a home is clean and well maintained. If it’s not, they’ll likely move on to the next.&lt;br /&gt;&lt;br /&gt;3. Sellers who stick around during an open house.&lt;br /&gt;&lt;br /&gt;There’s a reason why real estate agents don’t want sellers hanging around when potential buyers arrive. While a seller may be perfectly friendly and agreeable, they can alienate buyers or make them feel uncomfortable without even knowing it. I &lt;br /&gt;4. Sellers who hold out for extra money at the last minute.&lt;br /&gt;&lt;br /&gt;Say a buyer made an offer that was $40,000 less than what the seller wants. The agent and the buyer’s agent have gone back and forth with a series of counter offers. The seller is only about $3,000 from their dream price but they insist on trying to squeeze another $1,500 out of the buyer.&lt;br /&gt;&lt;br /&gt;During escrow, the buyer may find a reason to ask for that $1,500 or more back in credits anyway. In demanding more money, the seller may have created bad will, as well as stressed those involved in the purchase. When it comes down to it, extracting that last $1,500 may actually cost the seller more at the end of the transaction.&lt;br /&gt;&lt;br /&gt;5. Sellers who don’t clean up before turning over the keys.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;Sellers should imagine themselves as the future buyer. Would they want to walk into their new home and find 12 cans of old paint in the garage? Or an old sofa with a broken leg in the attic?&lt;br /&gt;&lt;br /&gt;The tip to sellers is to try to make the home as spotless as possible for the new owners. They’ll appreciate it and so will&amp;nbsp;your agent. I immediately went to the bank and they fixed the error immediately.&amp;nbsp; The mistakenly drawn funds&amp;nbsp;were returned and&amp;nbsp;overdraft charge.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;I can tell you when my wife called and said that a three dollar purchase was declined I about had a stroke. I then pulled up my account and saw our mortgage payment was paid twice (ouch).&amp;nbsp; My wife&lt;br /&gt;thought she might have hit the enter button twice. Many homeowners know people who want to live in their neck of the woods; this is one reason many seasoned real estate professionals hold their listings open to neighbors and send out postcards to neighbors announcing the listing - the neighbors might know people who are interested in your home! Also, neighbors who are out and about chatting with each other, laughing and playing with their kids, mowing their lawns or painting their fences, or even who just offer a smile and helpful area knowledge to the buyer-to-be they pass on the street can make a very favorable impression on prospective buyers.&lt;br /&gt;&lt;br /&gt;It’s a good idea, if and when you decide to list your home for sale, to touch base with neighbors you know and let them know; it’s in their best interests to get good new neighbors, so they might be able to go the extra mile in showing the neighborhood’s biggest asset - themselves - off to its best advantage.&lt;br /&gt;&lt;br /&gt;2. The right sights, smells and sounds. It’s no news flash that the view of a used car lot; stinky foods or animal smells; and the siren song of a fire station next door could be deal-killers. What might surprise is some of the right sights, smells and sounds that can help seal the sale of your home. My experience has been - agents, chime in here! - that the more natural beautiful sights, smells and sounds are, the more favorably they’ll be received by the largest population of prospective buyers. &lt;br /&gt;&lt;br /&gt;For example, playing a soundtrack of classical musical is fine, but will cause some skeptical buyers to wonder what noises you might be trying to cover up - especially if you’re in a condo or other potentially thin-walled property where neighbor noise might be an issue. On the other hand, birdsong can be attractive to some buyers. Artificial air fresheners? Not so much. The scent of the jasmine or lavender that grows in your yard? Even allergy victims can appreciate that.&lt;br /&gt;&lt;br /&gt;You might be desensitized to the amazing views of trees, mountains or even water outside your window, but pulling back the curtains so prospective buyers can see for themselves is an absolute must.&lt;br /&gt;&lt;br /&gt;Home buying is a multi-sensory experience - visual staging of the property itself is no longer a plus, it’s a must. But homes which create pleasant impressions that fire on all of a buyer’s sensory cylinders definitely have the edge on their competition.&lt;br /&gt;&lt;br /&gt;3. Your dog. The New York Times ran a piece a few months ago about sweet, well-behaved dogs (and cats!) who reportedly helped sell their owners’ Manhattan apartments. In a departure from the conventional wisdom that dogs should be removed and every trace of their presence erased from the home during showings, the article featured several buyers and brokers attesting to their belief that the presence of a particular cat or dog “help[ed] sell a property by making the place seem warmer or more appealing.” And I’m sure you’ve all heard me tell the story of the San Diego buyer who fell in love with a tract home listed at a price higher than all the nearly identical comparables he’d seen and wanted to make a full-price offer immediately - so long as the deal included the dog!&lt;br /&gt;&lt;br /&gt;Definitely consult with your agent before you decide to implement leaving your dog at home for showings as part of your plan. I’m a dog lover, and would be concerned that someone might inadvertently let one of “my girls” out, if I left them there while my house was being shown; as well, would-be buyers or their agents may have allergies your pet could set off. Lately, it seems like I’ve seen many brokers attempting to capture the best of both worlds by making sure that the family pet or even the broker’s own pet is captured in a charming tableau in 1 or 2 of the listing pictures, even if they’re not present at the home during showings. &lt;br /&gt;&lt;br /&gt;4. Your happiness. Video and even written love letters that extoll all the virtues for which you love your neighbors, your neighborhood and your property are contagious to buyers. I’ve seen sellers help buyers see their homes through their own loving eyes by posting videos on YouTube and including the link on the listing flyer or even by putting a binder containing a letter plus menus and flyers from their favorite neighborhood restaurants, dry cleaners and other local merchants out on the counter during showings.&lt;br /&gt;&lt;br /&gt;Wide-open curtains that let light stream in, light and bright paint and decor colors and other home features that science has proven make residents more happy and functional also create this thought process in a buyer’s mind: “Hmm, these people seem happy here. I could be, too.”&lt;br /&gt;&lt;br /&gt;Similarly, indicators that you invested a lot of love in your home, by keeping it in immaculate order and pristine condition, by tending a well-cared for kitchen garden, lovingly furnishing and making comfortable (if not overly customizing) your kids’ rooms, all create the feel that a home was happily lived in - it’s like staging your home with a life well-lived, not just paint and tile.&lt;br /&gt;&lt;br /&gt;5. The freeway or&amp;nbsp;train tracks&amp;nbsp;you thought was too close. There is such a thing as a freeway or elevated train tracks being too close to your home; if your place rattles or roars, for example, every time the train passes, chances any buyer will view that as a selling point are pretty slim. However, homebuyer attitudes toward being located near freeways and&amp;nbsp;rail lines&amp;nbsp;or bus lines are a-changing. Every upward click of gas prices renders buyers a tiny bit more interested in a location that is more commutable. &lt;br /&gt;&lt;br /&gt;Where yesteryear’s buyers were all about the posh exclusivity of far-out suburbia, today’s buyers are more interested in financial and ecological efficiency and convenience. The upbeat month for home sales data comes at the tail end of what was a weak 2010. Annual home sales saw a 4.8% drop in the metric from 2009 levels, but the final month rise in sales could be the beginning of more upside in the sector. The NAR report also shows that although there is still a lot of inventory in the property market, those inventories have been gradually going down. Inventories in December of 3.56 million homes represented 8.1 months of supply, compared with 9.5 months in November.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Stock prices are too high&lt;br /&gt;&lt;/b&gt;Buying a home is not only a deeply personal decision; it’s also a very serious investing decision. Should you invest in a new property now, or would you be better off funneling that money into stocks or other investments? Consider this — stock prices over the past 12 months, as measured by the S&amp;P 500 Index, are up over 25%. What this means is that if you are a long-term investor looking to put money to work, now is not really the best time to get into equities. Conversely, median home prices in 2010 were up just 0.3% according to the NAR. In equity market terms, a home could be likened to an undervalued stock.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;It’s cheaper to own than to rent&lt;br /&gt;&lt;/b&gt;Buying a home now could actually be cheaper than the alternative of renting. That’s the conclusion of real estate data firm Trulia. According to the company’s Rent vs. Buy Index, buying a property—including mortgage principal, interest, taxes and insurance—was actually cheaper than renting in 72% of cities around the country. The firm compared a year’s rent for a two bedroom apartment, condo or townhouse with the cost of buying a similar property in 50 big cities around the country. Some of the most affordable areas to buy right now, according to Trulia, are Las Vegas, Miami and Phoenix.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;Rising interest rates&lt;br /&gt;&lt;/b&gt;Another cost-related argument in favor of investing in a home right now is interest rates. We saw mortgage interest rates rise steadily during the final weeks of 2010, with the average rate for a 30-year, fixed-rate mortgage finishing at 4.71% in December. That number represents a 4.3% gain from November. As the economy continues improving, we are liable to see rates continue climbing. That means that now is the time to lock in what are still historically low mortgage rate — before the cost of that loan spikes any higher.&lt;br /&gt;&lt;br /&gt;&lt;b&gt;A great inflation hedge&lt;br /&gt;&lt;/b&gt;Historically, real estate and gold have been considered great hedges against inflation. And while the main measure of inflation, the Consumer Price Index (CPI) hasn’t gone off the charts. That’s because the CPI measure excludes food and energy prices. If you’ve been to the grocery store or bought a tank of gas in the last month, you know inflation is real. Plus, inflation is a game of expectations; if people think prices will be going up they tend to act. As the Federal Reserve has demonstrated, it is committed to printing more and more money, and hence debasing the dollar. Market values in a few places have increased a somewhat over the past few years and then dropped down again, there was often a remaining net gain. However, if someone saw their home rise 20% in value and then drop 10%, they see themselves as having lost money rather than having gained 10% in value. That negative-focused thinking can, and often will, discourage a person from establishing a realistic listing/sale price.&lt;br /&gt;&lt;br /&gt;So why isn't my house selling – The Reality of this issues is because of unrealistic expectations on the parts of sellers and agents alike. We are still trying to establish a market norm and anyone out there “trying” for a price that the market simply will not support is wasting the Prospective Buyers time as well as that of their Listing Agent. The truth is never easy to swallow. Fortunately many who really did want to sell, but who perhaps were not ready to accept the realities of the market, will now reconsider creating a listing price that is palatable to the market in their area. &lt;br /&gt;&lt;br /&gt;More so then any time in our history the public needs an educated real estate professional, it is now. There are far too many people parading themselves as Realtors®, yet have not stepped up to the plate relative to enhancing skills and knowledge to be the kind of resource the consumer wants and demands.
